GDPR… The General Data Protection Regulation (EU) 2016/679 (“GDPR”) is a regulation in EU law on data protection and privacy for all individuals within the European Union (EU) and the European Economic Area (EEA).

GDPR is here to stay and that is why DriverCheck is proactive when it comes to updating your processes and understanding our role as your service provider  in keeping on top of data compliance.

1.    DriverCheck obtain permission from every driver to check their driving licence via a “fair processing declaration” to check their driving licence with DVLA driver record, whether this is provided on paper or digitally. Whilst this isn’t a new concept, the way that the permission is gained, and the associated paperwork that comes with it, has changed since the 25th May 2018 in accordance to the DVLA.

 

2.   Since the 25th of May 2018, there is a legal requirement for employers making an driving licence checks as it ceases to be based upon just a driver approval, it will now focus on an employer obligation to ensure that any employee or nominated driver driving in the course or a company vehicle for their work are legally entitled to do so, as part of their duty of care requirement.

3.  The D796/ADD mandate form and the electronic E-consent have now been replaced since the 25th May 2018, and now that the DVLA’s deadline of the 25th August 2018 is past they will no longer be valid for further checks.

4.   The new D906/ADD “fair processing declaration” is valid for three years, replacing the D796/ADD mandate form.

5.    A new D906/ADD “fair processing declaration” has been issued by the DVLA which came into effect as of the 25th May 2018 which is GDPR compliant.

6.    As the DVLA’s deadline of the 25th August 2018 has past to get all the new declarations in place with its clients, clients can only have drivers licences checked if the new D906/ADD “fair processing declaration” has been obtained by form or electronic E-Declaration.

 

7.    Any businesses that do not have the new fair processing declaration completed are at risk of failing to meet their compliance standards if the next check is after 25th August, so do not delay, switch your drivers over today onto the new form or convert to the simple E-Declaration.
